Absent: Commissioner Johnson.

Further discussion:Commissioner Van Scoy inquired what will be done with this table of
information prepared by staff. Chairperson Nixt noted it appears that a 400 to 500 foot increase
in most cases would eliminate the need for a conditional use permit. Associate Planner Dalnes
questioned if the intent is to eliminate the need for conditional use permits for this purpose or to
limit the accessory space. Chairperson Nixt replied the intent is to include in the City Code the
square footage that should accommodate almost all reasonable uses, with unique circumstances
dealt with through conditional use permits reviewed under established creiteria. He directed staff
to come back to the Commission with a recommendation for the appropriate change to the City
Code.

Case #7: Public Hearing – Request for a Conditional Use Permit to Allow for Motor
Vehicle Sales with an Outdoor Display Area; Case of Lumax, LLC

Chairperson Nixt closed the regular portion of the Planning Commission meeting at 9:30 p.m. in
order to call the public hearing to order.

Public Hearing

Planning Commission/November 3, 2005
