<br />Chairperson Nixt called the public hearing to order at 9:30 p.m. <br /> <br />Presentation <br /> <br /> <br />Associate Planner Dalnes advised that Lumax LLC is applying for a conditional use permit to sell <br />and display vehicles for sale at the property located at 6246 Highway 10 NW. The site is zoned E- <br />2 Employment and guided as Places to Work in the Comprehensive Plan. The proposed use is <br />only allowed by a conditional use permit within this district. The existing building would be used <br />as a sales office. <br /> <br />Associate Planner Dalnes noted City Code states that a conditional use permit can be obtained to <br />conduct open or outdoor sales as a principal use within an E-2 Employment district if the <br />following criteria are met: <br /> <br />1)That the use does not take up required parking spaces or loading areas and, <br /> <br />2)That the sales area is surfaced with asphalt or concrete material to control dust. <br /> <br />3)The standards on determining the suitability of granting the conditional use permit are <br />met, per Section 9.03.05 of City Code. <br /> <br />Associate Planner Dalnes advised the site is paved in accordance with a site plan submitted on <br />November 15, 1995, and was inspected on July 28, 2000. The subject property and the <br />surrounding areas were consciously guided for manufacturing or industrial uses in the 2001 <br />Comprehensive Plan. This fact would put the request in conflict with the requirement that the <br />proposed request is harmonious with the objectives of the Comprehensive Plan. <br /> <br />Citizen Input <br /> <br /> <br />There was none. <br /> <br />Motion by Commissioner Levine, seconded by Commissioner Van Scoy, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Van Scoy, Brauer, <br />Shepherd, and Watson. Voting No: None. Absent: Commissioner Johnson. <br /> <br />The public hearing was closed at 9:39 p.m. <br /> <br />Commission Business <br /> <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 9:39 <br />p.m. <br /> <br />Chairperson Nixt stated he will be abstaining on this matter due to his uncertainty about who <br />currently controls the site. <br /> <br /> <br />Planning Commission/November 3, 2005 <br />Page 22 of 27 <br /> <br />
