WHEREAS, the Landowners have applied for a Building Permit to construct a 200 <br />square foot detached accessory structure (the "Accessory Structure") for a She Shed/Studio on <br />the Subject Property. <br />WHEREAS, Landowners application indicates that the Accessory Structure would <br />include a bathroom with both a toilet and shower, a sink/wash station, studio space, two (2) <br />windows, a front door and covered porch. <br />WHEREAS, Ramsey City Code Section 117-349(d)(8) prohibits detached accessory <br />buildings from containing complete independent living facilities (accessory apaitments) which <br />are defined as having three or more of the following: permanent provisions for living, sleeping, <br />eating, and sanitation. <br />NOW, THEREFORE, in consideration of the mutual covenants contained herein and <br />other good and valuable consideration, the parties agree as follows: <br />1. The City may issue a Building Permit for the Accessory Structure on the Subject <br />Property. <br />2. The Landowners acknowledge and agree that the Accessory Structure cannot be <br />used as an independent living facility (accessory apartment). <br />3. The Landowners shall be responsible for all costs relating to construction, <br />maintenance and repair of the Accessory Structure and shall obtain all permits required by the <br />City for its construction (septic, electrical, etc.). <br />4.
