Principal City Engineer Olson replied that he thinks it would be a cost the developers would feel <br />was a good use of the storm water management impact fund. <br />Motion by Councilmember Kurak, seconded by Mayor Gamec, to recommend that the City <br />Council authorize staff to hire Hakanson Anderson for a not to exceed amount of $2,000 to <br />survey the 864 contour and provide legal descriptions of easements necessary to achieve the 100 <br />year rainfall event and then bring it back for further consideration. <br />Further discussion: Councilmember Hendriksen stated that he wanted to point out that they are <br />looking at going back and acquiring the wetland, which is inconsistent to what they did earlier <br />this year. Councilmember Kurak replied that that was not true. She explained that the City will <br />address the remainder of the McDonald property when it is developed. Principal City Engineer <br />Olson noted that they would not necessarily be acquiring the wetland, but possibly the land next <br />to the wetland. Councilmember Zimmerman requested that staff look into a policy where the <br />City can determine where the dewatering can occur if a developer receives a permit from the <br />DNR. Councilmember Hendriksen stated that they are turning Class I wetlands into Class III <br />wetlands for a short time and if he has a pasture that is dry 90 percent of the time and someone <br />decides to turn that into a Class III wetland for a short t ime h e i s d amaged a nd t hey n eed t o <br />consider that. <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen, <br />and Zimmerman. Voting No: None. 0 <br />Case #3: Request for Maintenance of Private Street <br />Principal City Engineer Olson stated that at the October 8, 2002 City Council meeting, staff was <br />directed to bring a case to a future Public Works Committee meeting to discuss the possibility of <br />taking over the maintenance of the private street that serves as access for the townhomes of Rum <br />River Hills. On October 17, 2002, staff met with the residents of the townhouse association on <br />sire. The concerns that were expressed at that meeting included: <br />• They are paying property taxes for other streets that are maintained and want their street to be <br />maintained as well <br />• If t he C ity i s u nable t o take responsibility for their road, then they want the ability to be <br />reimbursed for the portion of their taxes that are going towards maintenance activities <br />• The streetlight for their development is at the intersection of Iodine Street and the private <br />road. They are paying for the electricity costs for this light and also paying a priority light <br />fee. <br />The current width of the street is 28 feet wide and there is a 36-foot radius on the cul-de-sac. <br />City code requires all new public streets to be 32 feet wide and those that are continuous have a <br />50-foot radius cul-de-sac with a 65-foot radius ROW. For the purposes of taking over the street, <br />current City requires a 25-foot setback for the principal building. In talking with the Community <br />Development Department, they do not remember any variance that was granted to that code.
