Principal City Engineer Olson replied that there was a lot of water in the wetland to begin with, <br />but he does not claim that it would never have happened. He explained that the difficulty with <br />dewatering is that the permit comes from the DNR and the City does not have much say over it. <br />Councilmember Hendriksen stated that if the City does not have e any regulations that limit where <br />a developer can pump water then there seems to be a problem. <br />Principal City Engineer Olson replied that the City did stop the dewatering a number of times <br />because of concerns. <br />Councilmember Hendriksen stated that if there is nothing in the ordinance that states the City has <br />to be consulted about dewatering activities there is a problem. <br />Principal City Engineer Olson replied that the City require that the developer receive all the <br />necessary permits. <br />Councilmember Hendriksen replied that that apparently is not sufficient. <br />Principal City Engineer Olson stated that the permit is issued by the DNR and the City has no <br />part of it. <br />Mayor Gamec stated that this was a very unique situation because one of the pipes was plugged. <br />Once the pipe was opened the water began moving and the water levels went down right away. <br />The swamp is so covered with brush that it should probably be cleaned out for the water to flow <br />better. <br />Principal City Engineer Olson requested authorization for an additional $1,000 for the wetland <br />delineation. <br />Councilmember Hendriksen stated that he did not think that developers should be assuming that <br />they can come along and discharge water into a Class I wetland and have standing water sit there <br />without having some sort of review occur with the City that makes sure it is not going to cause <br />substantial financial loss. He felt that there should be some kind of review by the City to assure <br />that the City will look at where the water is going to be discharged. <br />Councilmember Zimmerman stated that he was not sure that the additional easements were <br />necessary. <br />Principal City Engineer Olson explained that none of the residents have asked for the easements, <br />but the City has spent a lot of time determining what the water levels would be during a 100 year <br />event and want to make sure they acquire the property they are using. <br />• Councilmember Zimmerman inquired in the future if this happens should it be the City's <br />responsibility to purchase the easements of the developers. <br />Public Works Committee/November 19, 2002 <br />Page 9 of 15 <br />
