• <br />• <br />• <br />(Dogs Disturbing the Peace), of the Ramsey City Code, stated as follows: "It shall be <br />unlawful for any person to own, keep, have in possession, or harbor any dog which howls, <br />yelps, or barks to the reasonable annoyance of another person or persons. Any person <br />violating this section, who upon first requested by a Police Officer or Animal Control <br />Officer to stop or prevent the annoyance, and refuses to comply with the request will be <br />issued a citation or arrested in accordance with Minnesota Rules of Criminal Procedure, and, <br />if the Officer deems it necessary to stop the annoyance, may have the dog taken to the City <br />animal pound. Any dog placed in the pound may be reclaimed by the owner upon payment <br />of the fee prescribed in Sudb. 9, and if not reclaimed may be disposed of in the manner <br />provided in Subd. 11. <br />6. That upon any conviction of a dog disturbing the peace pursuant to Item #5 herein, the City <br />may also take action to revoke this Permit pursuant to its conditional use permit revocation <br />procedures. <br />7. This Permit is subject to all of the rules and conditions of other relevant City Code <br />provisions and in particular, it is subject to all the terms and conditions of Section 5.09.03 <br />(Dog Regulations). <br />8. That the outdoor exercise area as depicted on the site plan received by the City on September <br />8, 2000 shall be maintained in a sanitary condition according to State and local humane <br />standards. <br />9. That no dog under the ownership of the Permittee shall be allowed to run at large in an <br />unconfined area on the Subject Property, except under the direct supervision of the <br />Permittee. <br />10. That the City Administrator, or his /her designee, shall have the right to inspect the premises <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br />11. That the Permittee shall be responsible for City costs incurred in administering and <br />enforcing this conditional use permit. <br />The motion for adoption of the foregoing resolution was duly seconded by Mayor Gamec, and <br />upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Anderson <br />Councilmember Connolly <br />Councilmember Hendriksen <br />and the following voted against the same: <br />None <br />1 <br />RESOLUTION #00 --291 <br />Page 2 of 4 <br />
