• <br />• <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That on September 7, 2000, Al Kempf, hereinafter referred to as "Applicant ", properly <br />applied for a conditional use permit to exceed the front yard fence height restrictions. <br />2. That the Applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on October 3, 2000, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br />3. That the Subject Property and surrounding parcels are zoned R -1 Residential, except that the <br />adjacent parcel to the north is zoned B - Business. <br />4. That the Subject Property is located in the Metropolitan Urban Service Area. <br />5. That the Subject Property is approximately 1.4 acres in size. <br />6. That Section 9.20.12 of the Ramsey City Code states that only decorative fences are allowed <br />in the front yard and they shall not exceed forty -eight (48) inches in height. <br />7. That the Applicant is requesting permission to erect a 6 foot high wood, privacy fence in the <br />front yard to mitigate the loss of mature trees in the T.H. #47 improvement project that <br />previously provided a visual and audio buffer to the traffic. <br />8. That in order to save the remaining trees along the front property line, the Applicant is also <br />proposing to locate the fence approximately 2 to 3 feet into the T.H. #47 right -of -way. <br />9. That the Applicant must obtain a permit from Mn/DOT to locate the fence within the T.H. <br />#47 right -of -way. <br />10. That the proposed use will not adversely impact traffic in the area. <br />11. That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br />12. That the proposed use will not substantially adversely impair the use, enjoyment, or market <br />value of any surrounding property. <br />13. That the proposed use will not be hazardous or disturbing to existing or future neighboring <br />uses. <br />14. That the proposed use will not create excessive additional requirements at public cost for <br />public facilities and services, and it will not be detrimental to the economic welfare of the <br />community. <br />RESOLUTION #00 -10 -281 <br />Page 2 of 3 <br />
