Setback and buffer provisions shall also apply to <br />[and platted before the effective date of this ordinance but have not been graded for <br />development. <br /> <br /> Subd. 2. Subject properties must comply with the wetland buffer ordinance <br />setbacks from all wetlands including those wetlands not located or only partially located <br />on the subject property. <br /> <br /> Subd. 3. Buffer strip vegetation shall be established and maintained in accordance <br />with the requirements fbund in this Subdivision. During the first two (2) years, any buffer <br />vegetation that does not survive must be replanted. After two years; if the condition of the <br />buffer area changes through natural processes not caused by the property owner, the <br />owner shall not be required to reestablish the buffer area to meet the standards contained <br />in this Chapter. If buffer strips are developed as a part of a subdivision where lots are <br />intended for sales to individual parties, the project developer shall be responsible for <br />related maintenance for the first 2 years after establishment. Buffer maintenance and <br />liability after 2 years shall be the responsibility of the property owner. Buffer strips shall <br />be identified within each lot by permanent monumentation approved by the City. <br /> <br /> Subd. 4. For roadways that must be aligned either adjacent to or across wetlands <br />and are subject to WCA replacement requirements, additional wetland filling to create a <br />buff~zr strip shall not be required. All other roadways and trails shall meet the buffer <br />standards established in this Chapter. <br /> <br /> Subd. 5. Although [t is the intent of this ordinance that any existing wetland <br />buffer be maintained within the designated buffer width for the wetland classification, <br />some disruption may be necessary for developmental grading. If the slope subsequent to <br />final grading is greater than twelve (12) percent, then the maximum buffer width for the <br />wetland type is applicable. The use of a meandering buffer strip is encouraged to help <br />maintain a natural characteristic but average buffer widths must be adhered to. The <br />widest portion of the buffer should be in natural runoff areas. Construction grading <br />should be kept mindful of the natural runoff areas and graded appropriately. <br /> <br /> Subd. 6.
