• Councilmember Hendriksen introduced the following resolution and moved for its adoption: RESOLUTION #00 -04 -103 A RESOLUTION ADOPTING FINDINGS OF FACT #0518 RELATING TO ACE SOLID WASTE'S REQUEST FOR A CONDITIONAL USE PERMIT TO CONSTRUCT AND OPERATE A TRANSFER STATION FOR RECYCLABLES AND MIXED SOLID WASTES WHEREAS, Ace Solid Waste, Inc., hereinafter referred to as Applicant, has properly applied for a conditional use permit to construct and operate a transfer station for recyclables and mixed solid wastes in the Business Warehouse District on the property legally described as follows: Lot 2, AUDITOR'S SUBDIVISON NUMBER 30, except the southwesterly 80 feet thereof, subject to easements of record, Anoka County, Minnesota (" Subject Property" ) NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on April 10, 2000, and that the public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2) That the Applicant submitted the following documents in support of their application for a conditional use permit: a) Site Plan Sheet Al prepared by Lampert Architects dated February 14, 2000, revision dated February 24, 2000; b) Floor Plan Sheet A2 prepared by Lampert Architects dated March 28, 2000; c) Elevations Sheet A3 prepared by Lampert Architects dated March 28, 2000; d) Landscape Plan Sheet L1 prepared by Lampert Architects dated February 25, 2000; e) Preliminary Grading, Drainage, Erosion Control and Utility Plan prepared by Plowe Engineering, Inc. dated February 11, 2000; and f) a written description of the transfer station entitled "Phase II — Ace Solid Waste Recycling And Transfer Facility, Ramsey, MN" , dated March 24, 2000. 3) That the subject site is approximately 9 acres in size and is zoned Business Warehouse. 4) That the surrounding parcels to the north, east and west are zoned a combination of Industrial and Business Warehouse; the property on the south side of the Burlington Northern Railroad is zoned B -3 Highway Business and is occupied by a lawful non - conforming residential dwelling. 5) That the Applicant is proposing to relocate and develop their new office and truck terminal on the Subject Property. 6) That the Applicant has stated that the on -site transfer station is essential to efficient collection and ultimate disposal of mixed solid wastes and recyclables. 7) That Section 9.14 (Solid Waste) of the Ramsey City Code requires a conditional use permit for the operation of a transfer station in any zoning district.
