• • 4. The Permittee shall obtain all necessary permits prior to commencing any construction, including a permit from Anoka County for access onto County Road No. 63. 5. The Permittee shall make a reasonable effort to locate the residential structure and any accessory buildings constructed on the Subject Property so as not to interfere with the orderly resubdivision of the Subject Property at some point in the future, and by accepting this variance acknowledge that not doing so may adversely impact the ability of the Subject property to be subdivided in the future. 6. The Permittee shall be responsible for maintaining the driveway in a manner that will facilitate access by emergency vehicles, and this shall include a minimum of a 12 foot wide Class 5 surface and maintaining a tree and vegetation clearance of at least 5 feet on either side of the driveway. 7. The Permittee agrees that this Variance shall be recorded in the office of the Anoka County Recorder and agrees that the terms and provisions of this Variance shall run with the land and shall bind the property owner and his /her successor and assigns. 8. The Permittee shall be responsible for all City costs incurred in administering and enforcing this variance. The motion for the adoption of the foregoing resolution was duly seconded by Board Member Dempsey, and upon vote being taken thereon, the following voted in favor thereof: Board member Robert Johnson Board member Chris Dempsey Board member William Kociscak Board member Joe Wivoda and the following voted against the same: Chairperson Leo Anderson and the following abstained: None and the following were absent: Board member Michael Nixt whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the 4th day of April, 2000.
