• <br />• <br />4. The Permittee shall obtain all necessary permits prior to commencing any construction, <br />including a permit from Anoka County for access onto County Road No. 63. <br />5. The Permittee shall make a reasonable effort to locate the residential structure and any <br />accessory buildings constructed on the Subject Property so as not to interfere with the <br />orderly resubdivision of the Subject Property at some point in the future, and by accepting <br />this variance acknowledge that not doing so may adversely impact the ability of the Subject <br />property to be subdivided in the future. <br />6. The Permittee shall be responsible for maintaining the driveway in a manner that will <br />facilitate access by emergency vehicles, and this shall include a minimum of a 12 foot wide <br />Class 5 surface and maintaining a tree and vegetation clearance of at least 5 feet on either <br />side of the driveway. <br />7. The Permittee agrees that this Variance shall be recorded in the office of the Anoka County <br />Recorder and agrees that the terms and provisions of this Variance shall run with the land and <br />shall bind the property owner and his /her successor and assigns. <br />8. The Permittee shall be responsible for all City costs incurred in administering and enforcing <br />this variance. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Dempsey, and upon vote being taken thereon, the following voted in favor thereof: <br />Board member Robert Johnson <br />Board member Chris Dempsey <br />Board member William Kociscak <br />Board member Joe Wivoda <br />and the following voted against the same: <br />Chairperson Leo Anderson <br />and the following abstained: <br />None <br />and the following were absent: <br />Board member Michael Nixt <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this <br />the 4th day of April, 2000. <br />Resolution # 00 -04 -078 <br />Page 2 of 3 <br />
