• <br />family dwelling on the Subject Property and therein deprive the Applicants of rights <br />commonly enjoyed by other properties in the same district, resulting in an undue hardship. <br />7. That the Applicants also own the adjacent parcel to the west (PIN 08- 32 -25 -11 -0014) and are <br />proposing to grant a 33 foot wide access easement to C.S.A.H. #63, in recordable form, to the <br />Subject Property. <br />8. That Section 9.03.05 of the Ramsey City Code establishes that unless otherwise specified by <br />the Board of Adjustment at the time it is authorized, a variance shall become null and void <br />within one year after the final action of the Board of Adjustment if not initiated or utilized. <br />9. That the City has previously granted similar variances. <br />10. That the Board of Adjustment approved this same variance for this property on July 7, 1998, <br />but the variance was not initiated within one year of the final action of the Board of <br />Adjustment. <br />11. That the variance requested is the minimum variance, which would alleviate the hardship. <br />12. That the special landlocked conditions do not result from the actions of the Applicant. <br />13. That if granted, the variance will not permit a use that is prohibited in the R -1 Rural <br />Residential District. <br />14. That the granting of the variance will not grant the Applicant any special privileges that be <br />denied by this Chapter to other owners of land in the same district. <br />15. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br />16. That if granted, the variance will not be materially detrimental to the purposes of this Chapter <br />or other property in the same zone. <br />17. That if granted, the variance will not increase the danger of fire, or endanger the public <br />safety. <br />18. That if granted, the variance will not unreasonably diminish property values within the <br />neighborhood. <br />19. That if granted, the variance will not unreasonably increase the congestion in public streets. <br />20.
