Councilmember Connolly introduced the following resolution and moved for its adoption: <br />RESOLUTION NO. 00-03-074 <br />A RESOLUTION APPROVING THE ISSUANCE OF A GRADING PERMIT BASED ON <br />FINDINGS OF FACT #0511 AND DECLARING TERMS OF PERMIT <br />WHEREAS, the Ramsey City Council adopted Resolution No. 00 -03 -074 adopting <br />Findings of Fact #0511 for this use and herein approves the Grading Permit subject to the <br />following conditions. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />On March 28, 2000, a Grading Permit ( "Permit ") was issued by the City of Ramsey ( "City ") to <br />North Fork, Inc. ( "Permittee ") for grading operations on the property legally described as <br />follows: <br />Lots 3 and 4, Block 2, NORTH FORK LAKE ADDITION, Anoka County, Minnesota. <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br />1. This permit shall expire on September 28, 2000. <br />2. All equipment used for grading operations shall be maintained and operated in such a <br />manner to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. All equipment shall be kept in good repair. Failed equipment and rubbish <br />shall be removed from the worksite regularly. <br />3. All worksites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the worksite. <br />4. Existing tree and groundcover shall be preserved to the extent feasible. <br />5. Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br />6. No grading operations shall occur at below an elevation of 6 feet above the elevation of <br />the water table on the worksite. <br />7. Fencing may be ordered by the City Council or City Engineer anytime the permit is in <br />force and shall be installed within 24 hours of written notice. <br />8. All access roads to and from the Subject Property shall be maintained in order to <br />minimize dust. <br />9. The maximum slope other than the working face shall be sloped on all sides no steeper <br />than a rate of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working <br />face be left unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When <br />grading operations are anticipated to be discontinued for an interval greater than one <br />working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. <br />RESOLUTION #00 - - 074 <br />Page 1 of 4 <br />
