This financial guarantee may be used by the City to pay for the
cost and expense of repairing any public right of ways or regrading and stabilizing eroded
areas due to the grading operation, pay for any cost associated in administering the
requirements of this Chapter of the City Code, and to pay for any restoration of the
worksite not properly restored upon completion.
12. The Permittee shall implement sediment and erosion control practices. No grading
activity shall occur within twenty -five (25) feet of a property line unless silt fence is
placed along the property line to prevent sediment from washing onto the adjoining
property. Any erosion which causes gullies of greater than one (1) foot within twenty -
five (25) feet of a property line shall be regraded within forty -eight (48) hours of the
precipitation event that caused the erosion.
13. There shall be no stockpiling of graded materials, other than the topsoil on a temporary
basis on the Subject property. Topsoil stockpiles shall not exceed 900 cubic yards in total
nor six (6) feet in height.
14. The Permittee shall file with the City a liability insurance policy or certificate of such
insurance acceptable to the City and issued by an insurance company authorized to do
business in the State of Minnesota.
15. The policy shall insure the permit holder for the sum of at least $300,000 for injury to one
person and $500,000 for one accident, and at least $1,100,000 property damage.
16. Said policy shall be for the full period of the permit and shall provide for the giving of 10
days prior notice to the City by registered mail of termination, cancellation or amendment
of the policy.
17. In the event said policy is terminated for any reason, the permit shall be automatically
suspended upon the day the policy terminates unless a new policy complying with this
item is obtained and filed with the City prior to the termination of the policy in force.
18. The maximum noise level at the perimeter of the worksite shall be within the limits set by
the Minnesota Pollution Control Agency and the Environmental Protection Agency of the
United States.
19. All grading operations shall be conducted in accordance with the grading plan dated May,
16, 1995 prepared by Ulteig Engineers, Inc., revision dated November 3, 1999. The
proposed area to be graded is roughly two acres in size. Excavation of the entire area
shall be permitted. Continuation of grading shall require finished grade areas to be
restored with six (6) inches of topsoil, seed and disc anchored mulch.
20. All grading shall be completed within twenty -three (23) calendar days of the
commencement of the grading operation. Restoration of the turf by spreading a
minimum of four (4) inches of topsoil, fertilizer, seed and mulch shall be completed
within seven (7) calendar days of the completion of the grading.
RESOLUTION #00 -03 -074
