21. All costs incurred by the City in executing and administering this permit shall be the <br />responsibility of the Permittee. The Permittee shall maintain a minimum Five Hundred <br />Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used <br />to reimburse the City for expenses incurred in the administration of this permit. At the <br />time the mining operation and site restoration are completed to the satisfaction of the <br />City, the balance of the escrow shall be returned to the Permittee. <br />22. All grading operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays <br />only unless otherwise specifically approved by the City Administrator and/or his <br />designee. <br />23. The amount of dust or other particulate matter caused by the mining operation shall not <br />exceed the standards established by the Minnesota Pollution Control Agency. No <br />operation shall be allowed when wind gust exceed 30 miles per hour. <br />24. All operations shall comply with all applicable Minnesota Pollution Control Agency <br />regulations and Federal and Environmental Protection Agency regulations for the <br />protection of water quality. <br />25. All haul roads are subject to the approval of the City Engineer. While hauling operations <br />are in progress, the Permittee shall maintain the haul road in a condition satisfactory to <br />the City Engineer. When hauling operations are completed, the permit holder shall either <br />restore that haul road to a condition at least equal to that which existed at the time the <br />hauling operations were started, or compensate the local road authority in an amount <br />satisfactory to that road authority and concurred in by the City Engineer for the <br />restoration of that haul road. The City Engineer will then accept such restoration or <br />concur in such financial settlement for the restoration of the haul road in writing and such <br />acceptance will relieve the permit holder of any additional obligation in connection with <br />the restoration of the haul roads. If the Permittee fails or refuses to perform haul road <br />restoration or to make satisfactory financial settlement for such restoration, the City will <br />cause the restoration work to be done and require reimbursement from the financial <br />guarantee required herein. <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Thomas Gamac <br />Councilmember Margaret Connolly <br />Councilmember Gerald Zimmerman <br />Councilmember Susan Anderson <br />Councilmember Terry Hendriksen <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />None <br />RESOLUTION #00 -03 -074 <br />Page 3 of 4 <br />
