• <br />Councilmember Connolly introduced the following resolution and moved for its adoption: <br />RESOLUTION #00 -03 -073 <br />A RESOLUTION ADOPTING FINDING OF FACT #0511 RELATING TO A REQUEST <br />FROM NORTH FORK, INC. FOR A GRADING PERMIT <br />WHEREAS, the City of Ramsey received an application from North Fork, Inc. for a <br />grading permit to regrade the property legally described as follows: <br />Lots 3 and 4, Block 2, NORTHFORK LAKE ADDITION, Anoka County, Minnesota. <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That on February 15, 2000, North Fork, Inc., hereinafter referred to as "Applicant ", <br />properly applied for a grading permit to regrade property in the Northfork Planned Unit <br />Development. <br />2. That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on March 6, 2000, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />3. That the subject property is located in a residential area of a Planned Unit Development <br />and the proposed area for grading is approximately two (2) acres in size. <br />4. That on June 27, 1995 and again on August 26, 1997, the City issued a grading permit to <br />the Applicant to strip the topsoil, export approximately 15,000 cubic yards of earth <br />material, and replace the topsoil on the Subject property. <br />5. That the grading permits issued in 1995 and 1997 expired prior to initiation and <br />completion of the grading project. <br />6. That the City received a letter from the Applicant dated February 16, 2000 as an <br />addendum to the February 15, 2000 application for a grading permit, and that transmittal <br />stated that removal of the material from the site is cost prohibitive and the revised grading <br />plan proposes the movement of approximately 6,000 yards of material on the Subject <br />Property with no exporting of soils. <br />7. That the revised grading plan prepared by Ulteig Engineers, Inc., dated May 16, 1995 and <br />revised November 3, 1999, proposes to regrade the Subject Property to create more <br />attractive building sites and save mature Oak trees. <br />8. That the Applicant has stated that the project should have minimal adverse impact on the <br />adjacent residential parcels as the project can be accomplished within a thirty (30) day <br />period. <br />9.
