Absent: CouncilmemberCook. <br /> <br />Case #3: <br /> <br />Adoption of Ordinance to Repeal and Amend Sections of Chapter 4.70 of the <br />City Code which is Dealing with "Public Facilities and Improvements" <br /> <br />City Attorney Goodrich reviewed that during the Council work session of March 15, 2005, the <br />City Council directed the City Attorney and staff to work to develop language that would repeal <br />sections of Chapter 4.70 of the City Code. This section applies to any residential improved <br />Dropcr~y in thc City, which property has urban services available to it and which property has not <br />been assessed for benefits of said urban services. The Council directed staff to repeal sections <br />~hat reqt~ire sewer and water hook-up either by sale of property or need of repair for a private <br />sewer and/or private water system. On March 22, 2005, the City Council introduced the <br />proposed ordinance. Since that date, staff has reviewed the City Code and determined that <br />section ,qubcl. 2.a. of Subsection 4.40.07 should also be repealed. The ordinance now presented <br />R)r adoption contains that additional subdivision repeal. This ordinance is now eligible for <br />adoption. <br /> <br />C, ouncilmcmbcr Elvig stated many of the residents in his ward are very concerned about the <br />language in the current ordinance.
