CASE # <br /> <br />REQUEST FOR A GRADING PERMIT TO GRADE AND EXPORT SOILS; <br />CASE OF 'NORTH FORK, INC. <br /> By: City Engineer Steve Jankowski and <br /> Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On April 28, 1987, the City issued a grading permit to L&G Rehbein and North Fork, Inc. to grade <br />and excavate a lake in the Northfork P.U.D. Subsequent to the issuance of that permit, the City <br />Code pertaining to grading and mining permits was amended. In April of 1991, the permit was <br />reissued in accordance with the revised regulations. In August of 1991, that permit was transferred <br />from L&G Rehbein to Glenn Rehbein. The permit issued to Glenn Rehbein had an expiration date <br />of July 31, 1992. The permit lapsed and in November of 1995, the City issued a new permit to <br />complete excavation of the lake area and create walkout style home sites. That permit expired on <br />February 28, 1999, prior to the exporting of the materials. <br /> <br />Notification: <br /> <br />State law requires notification of the.public heating to all propei-ties Within 350 feet of the subject <br />property. Staff notified all properties within 500 feet of the subject property. <br /> <br />Observations: <br /> <br />North Fork, Inc. has applied for a reissuance of a grading permit to construct a second lake and <br />create some walkout style building sites in the area of the proposed plat of St. Andrews Addition in <br />the Northfork Planned Unit Development (PUD). <br /> <br />The grading plan proposes to export approximately 300,000 yards of sand from the 80 acre site. <br />This is a reduction from the 800,000 yard proposed in previous applications. The Applicant has <br />stated that the reduction is a result decreasing the size of the lake and not trying to make all of the <br />lots full walkouts. <br /> <br />There are several potential destinations for the exported materials: a) a project in Elk River; b) <br />City of Ramsey street improvement project to extend 153rd Avenue N.W. east of Armstrong Blvd. <br />N.W.; c) other areas of the Northfork P.U.D. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Applicant's letter of application <br />Proposed grading plan <br />Proposed findings of fact <br />Proposed conditional use <br /> <br /> <br />
