(c) Preparing and maintaining a comprehensive set of official maps identifying <br />the location and classification of all inventoried wetlands within the City. <br /> <br /> (d) Establishing wetland regulations that are coordinated with flood plain, <br />shoreland protection regulations and stormwater management. <br /> <br /> (e) Requiring sound management practices to protect, maintain, and improve the <br />quality of wetlands within the community. <br /> <br /> (f) Enforcing standards for the alteration of wetlands When alteration is allowed, <br />including standards and procedures for the mitigation of the loss of wetland areas and <br />their functions and values, when alteration or destruction occurs. <br /> <br /> (g) Obtaining protective easements over or acquire fee title to wetlands as <br />appropriate. <br /> <br /> (h) Developing and maintaining a program to educate the public about the <br />numerous benefits and features that wetlands provide and the adverse effects of <br />improperly managed urban development on wetlands. <br /> <br />9.26.03 <br /> <br />General Provisions. <br /> <br />Subd. 1. Identification and Delineation of Wetlands. <br /> <br /> (a) This Chapter shall apply to all land containing wetlands and land within the <br />setback and buffer areas as defined herein. Wetlands shall be subject to the requirements <br />established herein, as well as restrictions and requirements established by other <br />applicable Federal, State, and City ordinances and regulations. These wetland protection <br />regulations shall not be construed to allow anything otherwise prohibited in the zoning <br />district where the wetland area is located. <br /> <br /> (b) A wetland is land that meets the definition of "wetlands" set forth in Section <br />9.02 of this Chapter. Wetlands have been or will be identified and the Wetland, <br />cfassilication as established by the officially adopted City map's shall be prima facie <br />evidence of the location and classification of a wetland. The official maps shall be <br />developed and maintained by the Community Development Department and are open to <br />inspection by the public. The absence of a wetland on the official maps does not represent <br />a definitive determination as to whether a wetland covered by this Chapter is or is not <br />present. Wetlands that are identified during site specific delineation activities but do not <br />appear on the official wetland maps are still subject to the provisions of the Chapter. It <br />will be the responsibility of an applicant to delineate the exact wetland boundary or to <br />determine that no wetland exists on a subject property.
