If an applicant questions whether a wetland exists or disputes <br />its classification, the applicant shall have the burden to supply detailed information for <br />review supporting the applicant's assertion, including but not limited to, topographic, <br />hydrologic, fl0ristic and/or soil data deemed necessary by the City to determine the <br />jurisdictional status of the wetland, its exact boundary and its classification. Wetland <br />delineations supplied by applicants shall be certified by a qualified wetland delineator. <br />Wetland delineators must satisfy any certification requirements that may be established <br />by the U.S. Army Corps of Engineers or the Minnesota Board of Water and Soil <br />Resources. <br /> <br /> (c) This Chapter establishes four wetland classifications as defined in this <br />Chapter; Preserve, Manage 1, Manage 2 and Manage 3 wetlands. <br /> <br />(1) <br /> <br />The Preserve category is for exceptional m2d highest-functioning <br />wetlands or those sensitive wetlands receiving conveyed storm <br />water runoff that have yet retained a medium level of vegetative <br />diversity/integrity. These wetlands are those that should be <br />preserved in (or improved to) their most pristine or highest <br />functional capacity with wide, natural buffers, in perpetuity. <br /> <br />(2) <br /> <br />Manage 1 category are high-quality Wetlands that should be <br />protected from development and other pressures of increased use, <br />including indirect effects. Maintaining natural buffers will help to <br />retain the significant function these wetlands provide. In the event <br />that impacts to these wetlands cannot be avoided, replacement <br />ratios for mitigation should exceed the state-required minimums. <br /> <br />Manage 2 wetlands provide medium functional levels and the <br />wetland extent should be maintained. These wetlands often <br />provide optimal restoration opportunity. <br /> <br />(4) <br /> <br />Manage 3 wetlands have been.sUbstantially disturbed; replacement <br />considerations can be minimized after proper sequencing. <br /> <br /> (d) "Incidental" wetlands that are exempt from WCA regulation under Minn. <br />Rules 8420.0122 are not subject to the provisions of this chapter. <br /> <br /> (e) Temporary impacts from utility installation or maintenance that are exempt <br />from WCA regulation under Minnesota Rules 8420.0122 are not subject to the provisions <br />of this chapter. <br /> <br /> 9.26.04 General Standards.
