Recommendation: <br /> <br />It is Staffs understanding that horSes have been maintained on the 2.5-acre parcel since <br />1980. Maintaining horses on the property is compatible with the characteristic of the <br />neighborhood and consistent with surrounding uses. <br /> <br />The Horse Care Board and Staff are recommending approval of the conditional use <br />permit contingent upon the applicant providing verification that 4 acres is being leased <br />from Mr. Matuseski (the adjacent neighbor) and the permit specifying that if the lease <br />between the Dahlhemier's and Mr. Matuseski is terminated, the Applicant must remove <br />two horses from the property to comply with City Code restrictions of two horses on 1.5 <br />- less than 3 acres. The conditional use permit should also include Mr. Matuseski's <br />signature. This will put Mr. Matuseski on notice that the number of horses he is allowed <br />is decreased by four acres. The Horse Board and Staff are also recommending that the <br />conditional use permit include language that does not allow this case to set a precedent in <br />allowing leased land to count as acreage towards the number of permitted horses a <br />property owner can have. <br /> <br />This approval is an attempt to gain control of a non-conforming situation that has existed <br />since 1984. <br /> <br />Commission Action: <br /> <br />Motion to recommend that the City Council adopt Findings 6f Fact # . relating to a <br />request from Theresa Dahlheimer for a conditional use permit to maintain four horses on <br />property that includes 2.5-acres of owned property and 4 acres of leased land. <br /> <br />Motion to recommend that the City Council approve the Conditional Use Permit request <br />by Theresa Dahlheimer to maintain four horses on property that includes 2.5-acres of <br />owned property and 4 acres of leased land based on Findings of Fact # <br /> <br />-or- <br /> <br />Motion to deny the request for a conditiOnal use permit to maintain four horses on <br />property that includes 2.5-acres of owned property and 4 acres of leased land <br /> <br />Review Checklist: <br />Community Development Director <br />Principal Planner <br />City Attorney <br /> <br />PC: 02/06/01 <br /> <br /> <br />
