CASE

PROPOSED AMENDMENT TO TOWER ORDINANCE
By: Principal Planner Patrick Trudgeon

Background:

During discussion regarding the Tower Overlay District, the City CounciI instructed staff to draft
an additional amendment to the newly adopted tower ordinance. Specifically, the Council asked
that the setback from lot lines for towers be changed to 1 ½ times the height of the actual tower.

Observations:

As you know, the City recently made significant changes to ordinances governing the placement
of towers in residential districts. One of the adopted changes required that all towers be setback
at least 1 ½ times the height of the tower for any residential structure.

The City Council has asked that this language be changed to require that the 1 ½ times setback
be measured from the lots lines and not from any residential structure. (e.g. A 100-foot tower
would need to be setback 150 feet from any lot line).

Due to the proposed ordinance amendment, staff found that language regarding setbacks for
towers located in business and industrial districts needed to be clarified. This change is shown in
the ordinance.

The following items are enclosed for your information:

a)
b)

c)

Draf~ City Council Meeting Minutes for the January 9, 2001 meeting.
Excerpt of City Code with strikethroughs and underlines to identify proposed
changes to the text.
Proposed ordinance

Recommendation:

City Staff recommends approval of proposed ordinance.

Commission Action:

Motion to deny/approve ordinance

Review Checklist:
Community Development Director
City Attorney

PC: 02/06/01
