CASE <br /> <br />CONSIDER ORDINANCE TO AMEND GRADING REGULATIONS <br /> By: Principal Planner Patrick Trudgeon <br /> <br />Background: <br /> <br />The Public Works Committee has been working with City Staff regarding issues dealing with residential grading of <br />lots. The Committee instructed the staff to identify and propose language to rectify current problem areas. They <br />also ins~xucted staff to bring these issues to the Planning Commission for a public hearing and disCUssion. <br /> <br />The following items are enclosed for your information: <br /> <br /> a) Excerpt of City Code with strikethroughs and underlines to identify proposed changes to the text. <br /> b) Proposed ordinance <br /> <br />Observations: <br /> <br />The proposed ordinance addresses several areas of concern. Specifically, they are as follows: <br /> <br />· Require an elevation survey at the time of a footing and foundation inspection for new construction. This will <br /> ensure that the elevation of the foundation conforms to the overall grading plan of the area. This requirement <br /> may be waived at the discretion of the City Engineer it is determined that the elevation survey is not needed to <br /> ensure the compatibility of the grade of the lot with the overall area. <br /> <br />· A property owner shall not modify the grade of an existing lot that has an approved grading plan except after <br /> review and approval by the City Engineer. <br /> <br />· Allow for residents to create a pond without receiving a conditional use permit provided the created pond has a <br /> water surface of less than one-third of an acre. <br /> <br />· Grades less than 1% shall not be allowed.
