CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO <br />EXCEED ACCESSORY STRUCTURE RESTRICTIONS; <br />CASE OF MR. STICKNEY <br /> By: Megan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />The City received an application from Mr. Stickney requesting a conditional use permit to <br />exceed the detached accessory building square footage restriction and the maximum number of <br />accessory buildings allowed on the property located at 7956 173ra Avenue. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Site pictures <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. <br /> <br />Observations: <br /> <br />The subject property is approximately 5.1 acres (225,000 square feet) in size and is zoned R-IR <br />Rural Residential. On a 5.1 acre parcel, City. Code allows a maximum of 3,264 square feet of <br />detached accessory building space and a maximum of three accessory buildings on the property. <br />The applicant currently has ten (10) accessory buildings on the property and a total accessory <br />building area of 5,967 square feet. <br /> <br />Staff met with Mr. Stickney on Tuesday, April 24, 2001. We walked the property in order to get <br />a better understanding of where the accessory buildings are located and what the accessory <br />buildings are being used for. Staff determined that the number and size of the structures does not <br />diminish the use and aesthetics of the property. Staff also observed that Mr. Stickeny uses the <br />accessory buildings for cars that he collects and other various hobby equipment and materials <br />that he works on. <br /> <br />Mr. Stickney would like to replace an existing 40 x 40 (1,600 square feet) accessory building <br />with a 50 x 30 (1,500 square feet) accessory building. During the snowy winter months the roof <br />of the 1,600 square foot accessory building caved in and as a result it will need to be removed <br />from the property. The existing 1,600 square feet accessory building contains storage of vehicles <br />and other miscellaneous hobby items. Mr. Stickney will move these items into the proposed <br />1,500 square foot accessory building. <br /> <br />If Mr. Stickney replaced the 1,600 square foot accessory building with a 1,500..~ square foot <br />accessory building, the property would contain a total accessory building area of 5,867 square <br /> <br />I <br /> <br /> <br />
