CASE

CONSIDER ORDINANCE TO AMEND GRADING REGULATIONS
By: Principal Planner Patrick Trudgeon

Background:

The pUblic Works Committee has been working with City Staff regarding issues dealing with
grading of residential lots. The Committee instructed the staff to identify and propose language
to rectify current problem areas. They also instructed staff to bring these issues to the Planning
Commission for a public 'hearing and discussion.

The following items are enclosed for your information:

a)
b)

c)

Draft Minutes of the April 3, 2001 Planning Commission Meeting
Excerpt of City Code with strikethroughs and underlines to identify proposed
changes to the text.
Proposed ordinance

Observations:

The proposed ordinance addresses several areas of concern. Specifically, they are as follows:

Require an elevation survey at the time of a footing and foundation inspection for new
construction. This will ensure that the elevation of the foundation conforms to the overall
grading plan of the area. This requirement may be waived at the discretion of the City
Engineer if it is determined that the elevation survey is not needed to ensure the compatibility
of the grade of the lot with the overall area.

· A property owner shall not modify the grade of an' existing, lot that has an aPproved grading ·
plan except after review and approval by the City Engineer.

Allow for residents to create a pond without receiving a conditional use permit provided that
the new pond has a water surface of less than one-third of an acre. At your April 3ra meeting,
the Planning Commission raised concern regarding this proVision. To limit the possibility of
having a large pond being constructed without review by the City, staff has added language
that states that a C.U.P will not be required when constructing ponds with a water surface of
less than one-third of an acre or having a surface area of less than 20% of the lot size,
whichever is less.

· Grades less than 1% shall not be allowed. If a grade is proposed to be less than 2%, a
certificate of grading will be required prior to occupancy.

Further review of the ordinance by staff indicated that one additional change should be brought
forward at this time. Currently, a grading permit requires a conditional use permit with a three
year term limit. Given the limited duration of the permit, staff feels that an interim, use permit is
