CASE # <br /> <br /> REQUEST FOR AN INTERIM USE PERMIT' <br /> FOR OUTDOOR PAINTBALL ACTIVITIES; <br /> CASE OF DIEHARD PAINTBALL <br />By: Megan Wald, Community Development Assistant <br /> <br />Background: <br /> <br />The City has received a request for an interim use permit from Diehard Paintball to establish an <br />outdoor paintball course on the property located at 14622 Ferret Street. <br /> <br />The property has been used in the past several years for various outdoor recreational activities. <br />The City granted a conditional use permit in 1988 for the go-cart track, bumper boats, and the <br />miniature golf course. The conditional use permit was amended in 1994 to include batting cages <br />and a driving range. The property owner has not been operating any recreational activities on the <br />property for several years. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Proposed site plan <br />c) Letter of intent from the Applicant <br />d) Proposed Findings of fact <br />e) Proposed Interim Use Permit <br /> <br />Notification: <br /> <br />State law requires notification to properties within 350 feet of the boundaries of the subject <br />property. <br /> <br />Observations: <br /> <br />Brian Gower is proposing to lease the subject property from KRH Land LLC to facilitate a <br />paintball business. The property is zoned industrial and recreational .activities are not a permitted <br />use. In the past the City has required conditional use permits to be obtained for outdoor <br />recreational activities in any district. However, due to the close proximity of this parcel to the <br />opportunity site (smart growth site) and the parcel being designated for mixed use in the March <br />2001 draft comprehensive plan, Staff is suggesting that the application be processed as an interim <br />use permit. City Code states that interim use permit can be in effect for a maximum of 5 years. <br />Providing a 5-year cap on the recreational use request will allow the City the time needed to plan <br />for any permanent mixed-use development that best suits this site. The Applicant is aware of the <br />interim use permit 5-year expiration date and is supportive of receiving an interim use permit <br />instead of a conditional use permit. <br /> <br /> <br />
