Case #8: <br /> <br />Request to Rezone Property from B-1 Business and R-1 Single Family <br />Residential to Planned Unit Development; Case of Royal Oaks Realty, Inc. <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 10:26 p.m. <br />in order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 10:26 p.m. <br /> <br />Presentation <br /> <br />Principal Planner Tmdgeon stated that Royal Oaks Realty has submitted an application to rezone <br />property located at the southwest comer of CSAH 5 (Nowthen Blvd.) and Dysprosium Street <br />from B-1 Business and R-1 Single Family Residential to Planned Unit Development (P.U.D.). <br />The rezoning would allow the property to be subdivided for 73 single-family lots, 152 townhome <br />units and 82 apartment units. The property is 86.71 acres in size and is within the Metropolitan <br />Urban Service Area (MUSA). The preliminary plat accompanying the application proposes to <br />develop 73 single family homes on the western part of the property, 152 townhomes along <br />Nowthen Blvd., and a 82 unit apartment building for senior citizens along Dysprosium St. The <br />current Comprehensive Plan identifies this area for commercial and single family development. <br />The March 2001 Draft Comprehensive Plan shows this area as being High Density Residential <br />along Dysprosium St., Medium Density Residential along Nowthen Blvd. and Low Density <br />Residential on the western part of the property. The development property is adjacent to <br />property that is predominately surrounded by property that is zoned R-1 Single Family <br />Residential, with the exception of a parcel north of the development property that is zoned R-3 <br />Urban Residential, and a portion of the Flintwood Hills P.U.D. that is adjacent to the southeast <br />portion of the development property. The Lord of Life property lying on the northeast side of <br />Nowthen Blvd. is zoned B-l, Business and the Savannah Oaks Senior Apartment Building on the <br />eastern side of Dysprosium is zoned MR Multi-Family Residential. A minor Comprehensive <br />Plan amendment may e required if the March 2001 Draft Comprehensive Plan is not adopted by <br />City Council by the time their proposal has completed all necessary reviews. The landscape plan <br />meets the 20% open space requirement for a Planned Unit Development. Staff recommends <br />approval of the request for rezoning of the property from B-1 Business and R-1 Single Family <br />Residential to Planned Unit Development. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Commissioner Johnson, seconded by Chairperson Nixt, to close the public hearing. <br /> <br />Motion Carried.
