The public hearing closed at 10:27 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 10:27 <br />p.m. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Sweet, to recommend that City <br />Council adopt the Findings of Fact relating to a request to rezone the proposed plat of The Ponds <br />form B-1 Business and R-1 Single Family Residential to Planned Unit Development and to <br />recommend that City Council approve the request to rezone the proposed plat of based on the <br />findings of facts. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Sweet, Kociscak, <br />Reeve, and Watson. Voting No: None. <br /> <br />Case 1t9: <br /> <br />Request for Site Plan Review for Townhomes Located within The Ponds <br />subdivision; Case of Royal Oaks Realty, Inc. <br /> <br />Principal Planner Trudgeon stated Mr. Michael Black of Royal Oaks Realty, Inc. has applied for <br />site plan review for a townhome development to be located within The Ponds subdivision. The <br />applicant is planning on constructing 152 townhome units. The townhouse development is <br />generally located along CSAH 5 (Nowthen Blvd.) northwest of the City Water Tower. The <br />applicant has submitted an application for the rezoning of the development property from B-l, <br />Business and R-l, Single-Family Residential to Planned Unit Development (P.U.D.). The <br />rezoning would allow the property to be subdivided into 73 single-family lots, 152 townhome <br />units and 82 apartment units. The townhome development will be constructed in an area that is <br />roughly 16.63 acres in size. The gross and net density of the townhomes is proposed to be 9.14 <br />units per acre. The area proposed to be developed as townhomes lies within areas designated as <br />low, medium, and high density residential on the March 2001 Draft Land Use Map. Calculations <br />by staff shows that the area used for the townhomes would be allowed to have about 139 housing <br />units under the March 2001 Draft Comprehensive Plan. However, the number of units that the <br />development shows is less than the maximum number of units that would be allowed under the <br />March 2001 Draft Comprehensive Land Use Map. (Approximately 340 units would be allowed <br />if the development is a P.U.D. Royal Oaks Realty shows 307 dwelling units). The townhome <br />units comply with all setback requirements. The closest townhome unit is about 28 feet from the <br />rear lot line of the nearest new single-family lot, 140 feet from the rear lot line of an existing <br />single-family lot on 142na and about 35 feet from the lot line of the existing large lot on Nowthen <br />Blvd. The units are also setback at least 35 feet from the proposed Iodine St. right-of-way. The <br />townhome portion of the development will consist of eighteen (18) eight-unit townhome <br />structures and two (2) four-unit townhome structures for a total of 152 units. City Code <br />establishes that multiple family structures of 3 or more units are subject to a site plan review. <br />The townhomes are two-story, slab on grade, two and three bedroom townhome units.
