Chairperson Nixt closed the regular portion of the Planning Commission meeting at 7:56 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:56 p.m. <br /> <br />Presentation <br /> <br />Community Development Assistant Wald stated that the City has received a request for an <br />interim use permit from Diehard Paintball to establish an outdoor paintball course on the <br />property located at 14622 Ferret Street. The property has been used in the past several years for <br />various outdoor recreational activities. The City granted a conditional use permit in 1988 for the <br />go-cart track, bumper boats, and the miniature golf course. The conditional use permit was <br />amended in 1994 to include batting cages and a driving range. The property owner has not been <br />operating any recreational activities on the property for several years. Brian Gower is proposing <br />to lease the subject property from KRH Land LLC to facilitate a paintball business. The property <br />is zoned industrial and recreational activities are not a permitted use. In the past the City has <br />required conditional use permits to be obtained for outdoor recreational activities in any district. <br />However, due to the close proximity of this parcel to the opportunity site (smart growth site) and <br />the parcel being designated for mixed use in the March 2001 draft comprehensive plan, Staff is <br />suggesting that the application be processed as an interim use permit. City Code states that <br />interim use permit can be in effect for a maximum of 5 years. Providing a 5-year cap on the <br />recreational use request will allow the City the time needed to plan for any permanent mixed-use <br />development that best suits this site. The Applicant is aware of the interim use permit 5-year <br />expiration date and is supportive of receiving an interim use permit instead of a conditional use <br />permit. The applicant is proposing to utilize the existing infrastructure, which consists of a small <br />retail store and an accessory building. The accessory building will facilitate storage of paintball <br />equipment and the retail building will be an area for people to register and purchase any paintball <br />supplies or equipment. In the future Diehard Paintball may desire to utilize the existing <br />miniature golf course since it is still in great condition. Diehard Paintball will be utilizing the <br />existing parking lot, which should provide enough parking spaces for the number of customers <br />projected. The applicant is not proposing to construct any permanent structures. The site plan <br />indicates that the paintball course will consist of various barricades that will be constructed out <br />of wood and pallets. It is Staff's understanding that there will not be any change to the existing <br />grade. The paintball courses will need to be changed frequently to provide variety to customers <br />and therefore constructing permanent structures will not provide Diehard Paintball the flexibility <br />they desire for their customers. The applicant is proposing to have business hours of 10:00am - <br />10:00pm Monday through Friday, 8:00am - 10:00pm Saturday and 12:00pm - 10:00pm on <br />Sunday. Brian is estimating approximately 50 - 75 customers Monday through Friday and 75 - <br />100 Saturday and Sunday. Before any customers can set foot onto the outdoor paintball course, <br />they must watch a safety video and be issued a safety certification card. The City granted a <br />conditional use permit to Diamonds Sports Bar for a splat ball course on their property.
