Mr. Lind answered he talked with contractors and expects to be done before winter. The <br />concrete contractor could work in the first 30 days of getting the permit. He is anticipating a <br />total time lapse of 90 days. <br /> <br />Motion by Commissioner Sweet, seconded by Commissioner Watkins, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Vice Chair Kociscak, Commissioners Sweet, Watkins, Johnson, <br />and Reeve. Voting No: None. Absent: Chairperson Nixt. <br /> <br />The public hearing adjourned at 10:10 p.m. <br /> <br />Commission Business <br /> <br />Vice Chair Kociscak called the regular meeting of the Planning Commission back to order at <br />10:10 p.m. <br /> <br />Commissioner Sweet stated her husband works for a trucking company. She said she would not <br />approve of the trucks and trailers in her yard that her husband could bring home. She thought <br />Mr. Lind's property was unsightly and the garage would not solve the ultimate problem. She <br />stated she saw this structure as a short-term remedy that would cause trouble in the future. <br /> <br />Community Development Director Frolik explained if there is a violation of the conditional use <br />permit, the City notifies the property owner in writing. The property owner then has 30 days to <br />comply and if they do not, a hearing is scheduled with the City Council. <br /> <br />Vice Chair Kociscak questioned whether the property would have 30 days to comply each time <br />he receives a citation. <br /> <br />Motion by Commissioner Johnson to recommend that City Council adopt Findings of Fact <br />favorable to the applicant's request for a conditional use permit to exceed the amount of <br />accessory structure space allowed on the subject property. <br /> <br />Motion failed due to lack of a second. <br /> <br />Motion by Commissioner Sweet and seconded by Vice Chair Kociscak, to recommend that City <br />Council adopt findings of fact 1 through 12 favorable to the applicant, 13 and 14 unfavorable to <br />the applicant, and 15 and 16 and 17 favorable to the applicant and deny Mr. Lind's conditional <br />use permit request, based on the findings of fact. <br /> <br />Further discussion: Commissioner Reeve stated the other direction is that Mr. Lind has a right to <br />screen his larger vehicles, and the personal vehicles must be parked on a Class V parking pad. <br />Another option is to keep the vehicles off-site.
