Chairperson Nixt stated he is sympathetic. He explained there is good direction from the City <br />Council and Staff and this may not remedy the situation. He stated there are other remedies <br />available. He noted the City has granted Conditional Use Permits for allowable space for <br />accessory structures. The separate dwelling is a separate issue. He stated he does not see this as <br />an attractive solution. <br /> <br />Chairperson Nixt stated he would deny for reasons listed by Staff. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to recommend that the City <br />Council adopt findings of fact, unfavorable to the applicant, and deny Mr. And Mrs. Young's <br />request for a conditional use permit. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Reeve, and Watson. <br />Voting No: None. Absent: Commissioners Johnson and Sweet. <br /> <br />Case #4: <br /> <br />Request for a Conditional Use Permit to Exceed Accessory Structure Square <br />Footage Restrictions Case of Bradley Wolf <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:00 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 8:00 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Assistant Wald stated that the City received an application <br />from Bradley Wolf requesting a conditional use permit to exceed the accessory structure square <br />footage restrictions established in City Code on the property located at 6421 Green Valley Road. <br />The subject property is approximately 53 acres in size and is zoned R-1 Rural Residential. City <br />Code allows a maximum of 5,664 square feet of accessory structure space on parcels 10.6 acres <br />and greater in size. The applicant currently maintains 6,454 square feet of accessory structure <br />space on the subject property, which exceeds City Code restrictions by 790 square feet. Mr. <br />Wolf would like to replace an existing deteriorating 38' x 65' (2,470 square feet) accessory <br />structure with a 40' x 96' (3,840 square feet) accessory building. Mr. Wolf is requesting to <br />replace the structure with a larger accessory structure to facilitate projected storage needs for his <br />personal equipment and agricultural items from Green Valley Greenhouse. Constructing a 40'x <br />96' (3,840 square foot) accessory structure on the subject property will result in a total of 7,824 <br />square feet of accessory structure space on the property. This would exceed City Code accessory <br />structure restrictions by a 2,160 square feet. The City has approved several overages in the past. <br />Staff is recommending approval due to the nature of the parcel and the intended use of the <br />accessory structure. <br /> <br />Planning Commission/September 10, 2001 <br /> Page 6 of 24 <br /> <br /> <br />
