Motion by Commissioner Kociscak, seconded by Commissioner Reeve, to recommend that the <br />City Council deny Mr. Wolf's request for a conditional use permit to exceed the accessory <br />structure square footage restrictions established in City Code based on the Findings of Fact with <br />variables favorable to the denial. <br /> <br />Motion Carried. Voting Yes: Commissioners Kociscak, Reeve, and Watson. Voting No: <br />Chairperson Nixt. Absent: Commissioners Johnson and Sweet. <br /> <br />Case #5: <br /> <br />Request to Rezone Certain Property from R-1 Rural Residential to R-1 <br />Urban Residential; Case of Jacob Barthold and Oakwood Land <br />Development, Inc. <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:15 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 8:15 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that the City received an application from Jacob <br />and Therese Barthold and Oakwood Land Development requesting a rezoning of property in <br />Section 14 from R-1 Rural Residential to R-1 Urban Residential to permit development of the <br />subject property with single family residential lots served by sanitary sewer and municipal water. <br />The property is approximately 9.7 acres in size. At Mr. Barthold's request, the subject property <br />was part of a Comprehensive Plan amendment initiated in 1993 by the City of Ramsey for a <br />MUSA boundary expansion. By the time the amendment was approved by Metro Council in <br />1995, a portion of Mr. Barthold's property, which is the subject of today's request, was not <br />included in the MUSA boundary expansion exhibit. The fact that this portion of Mr. Barthold's <br />property is not in the MUSA came to light during the preliminary plat review of Apple Ridge <br />(ensuing phases named River Pines) in 1997. The preliminary plat was modified to eliminate <br />this portion of Mr. Barthold's property. Therefore, the current Comprehensive Plan retains this <br />property for single family residential uses at rural standards. If the City is inclined to grant the <br />rezoning, it would have to be conditioned upon an amendment to the current Comprehensive <br />Plan to include the subject property in the MUSA boundary. The March 2001 Draft <br />comprehensive Plan proposes to include the subject property in the next MUSA expansion. City <br />Staff recommends approval of the rezoning. <br /> <br />Citizen Input <br /> <br />John Peterson of Oakwood Land Development, Inc. stated that there is a lot of history on this <br />parcel.
