Mr. Lepper replied he has and has no objections.

Community Development Assistant Wald noted the Parks and Utilities Supervisor is generally in
favor of the park, with a few minor adjustments.

Jim Hanson, 14641 Fluorine Street, stated he understands the road is going through to Lord of
Life Church. He said the plan that was mailed to homeowners did not have that connection.
Since that is the plan, he has no concerns.

Woody Nelson, Lord of Life Church, stated he would like to work with the developer on the
positioning of that road.

Mr. Lepper said they could work together.

Dave Osborn, 14711 Erkium Street commented that everyone on his side of the block is in favor
of this development. His concern was that the plans that were shown at the neighborhood
meeting did not change. He also voiced his concern regarding the walking path. It would be
directly behind his house, and he was concerned aboUt the safety factor with it so close. He
would like to see the trail moved farther back from the houses on the west property line.

Community Development Assistant Wald noted the Park Commission would be discussing this
at their next meeting on November 15.

Mr. Osborn said he was in favor of the road connecting with the Lord of Life property. He said
that because the townhomes are so high, he is concerned they could look right into his house. If
there are any changes to the plans, he requested to be notified.

Mark Wilson, 14761 Erkium Street, agreed with Mr. Osborn regarding the trail. He also
remarked that he is fond of a certain tree on the Katnis property. He would like to keep the tree;
it shelters his home. He said he is in favor of the pond. He would like to work with Orrin
Thompson to relocate the path.

Mr. Lepper responded that the trail position is not yet set. It is added to the plans per the City
requirements, and he said he is open to working with the residents on the trail corridor.

Motion by Commissioner Johnson, seconded by Chairperson Nixt to approve the general design
plan of Birch Hill Lodges contingent upon compliance with City Staff review letter dated
November 2, 2001 and noting that the actual number of units is subject to change, and noting that
the trail should be an east-west trail along the south plat .boundary to Cobalt Street.

Motion Carried.
