He said it is an erroneous statement that the City has not <br />been to the site to monitor. <br /> <br />Chairperson Nixt questioned how Mr. Enstrom would respond to the noise complaints. <br /> <br />Mr. Enstrom stated he has to pump from one pond to another. When the digging is done, the <br />pump is turned off. He said they are not de-watering; just transferring the water. He said he has <br />not pumped water into ditches. There is no sludge or sediment build-up from the water. He <br />passed pictures out. He commented that he had 3 neighbors on 178t~ street asked him to pump <br />water down their ditches. He turned the pump on for them, and melted the snow in the ditch so <br />they would avoid spring flooding. He noted that in the summer, people have windows open, and <br />that is the optimum time for him to dig. He stated he has to work when it's feasible. He is never <br />open on Sunday and passed a brochure around which states the hours. He said he does work 7 <br />days a week in the summer when he has to. <br /> <br />Commissioner Brauer asked if the topsoil Mr. Enstrom removes is sold. <br /> <br />Mr. Enstrom answered it is. He offered photos, including one aerial photo. He added that the <br />neighbors on the south appreciate that he has raised the value of their homes with this project. <br />He stated that one neighbor had his home reassessed for refinancing, and it is worth $70,000 <br />more than what he purchased it for one and a half years ago. The reason for that is now he has a <br />lake view. He also stated that his machines have been maintained. <br /> <br />Motion by Commissioner Johnson, seconded by Chairperson Nixt, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Brauer, Sweet, and <br />Watson. Voting No: None. Absent: Commissioners Kociscak and Reeve. <br /> <br />The public hearing closed at 7:47 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:47 <br />p.m. <br /> <br />Commissioner Johnson asked Staff if this seems to be more of a compliance issue. He inquired <br />what the process is if someone were to call in concerned about operating after the hours <br />designated by the permit. <br /> <br />Community Development Director Frolik responded the engineers would handle the complaint. <br /> <br />City Engineer Jankowski stated he has been out to site once in the past week.
