City Engineer Jankowski said he would <br />then go to the applicant's place and inform him of the complaint. <br /> <br />Commissioner Sweet asked if the pump is loud. <br /> <br />City Engineer Jankowski replied he was standing right above it, and the noise was as he <br />expected; not out of the ordinary. <br /> <br />Mr. Matuseski stated he did call the City and the police. <br /> <br />City Engineer Jankowski stated he was not aware of any formal complaints. <br /> <br />Commissioner Sweet stated that the City issued a 3-year permit to Mr. Enstrom with the <br />assumption the project would be complete in 3 years. She asked why it isn't complete. <br /> <br />Community Development Director Frolik said it is not unusual for grading projects to take more <br />than 3 years. These projects are dependent on the weather, which can lengthen the time it takes <br />to complete them, and a market for the excavated soils. <br /> <br />Commissioner Brauer questioned if an EIS is required.on this. He said he was concerned that <br />this is not sidestepped. He suggested this be researched. He stated the citizens raised a fair <br />amount of environmental issues and he wanted to be assured they would be addressed. He also <br />questioned whether this could be a soil business rather than a pond excavation. If Mr. Enstrom's <br />motivation is to sell dirt, it would be in his best interest to not sell it as quickly as possible and <br />spread out the project so he has a more steady income of selling the dirt. However, he said if this <br />use falls within the land use designation, it is his prerogative. <br /> <br />Chairperson Nixt stated this Conditional Use Permit to grade and export soils is the only type of <br />permit that can fit this project. This property is in the rural preserve and zoned Rol Residential. <br />He questioned if this is a business operation and whether there are employees. Possibly, it <br />should be following the home business criteria. <br /> <br />Commissioner Watson noted that Mr. Enstrom has 2 full time employees, as per the staff report. <br /> <br />Chairperson Nixt questioned whether having employees in a home business is prohibited. He <br />also questioned whether new wetland laws apply to this. He stated that this issue needs more <br />investigation.
