Mr. Enstrom stated he did request a 5-year term on the permit. He said he did everything himself <br />the first 2 years and used old equipment that was functional. He said he could have brought in <br />much more equipment to continue to work himself, but that would cause too much noise. <br /> <br />Commissioner Johnson questioned why this situation wasn't brought up to the Planning <br />Commission months ago. <br /> <br />Mr. Enstrom responded he noticed the permit was up and he should reapply. There was nothing <br />that suggested the reapplication should be 3 months before the expiration date. <br /> <br />Commissioner Johnson asked what ramifications would there be to shut down the operation. <br /> <br />Mr. Enstrom replied he would need to have subsidization to pay for unemployment. <br /> <br />Chairperson Nixt pointed out that the Planning Commission is a recommending body and cannot <br />grant an extension, nor shut the operation down. The Commission can only recommend the City <br />Council extend the permit or deny it. He explained that without a permit, Mr. Enstrom cannot <br />operate and the City could enforce that, which in essence would shut his operation down. <br /> <br />Mr. Enstrom stated the false statements by neighbors should not be used for making a <br />recommendation. <br /> <br />Motion by Commissioner Johnson to continue this matter to the next meeting of the Planning <br />Commission in December. <br /> <br />Motion failed due to lack of a second. <br /> <br />Chairperson Nixt explained to Mr, Enstrom that there are two choices. The item can be <br />continued, which means no action would be taken at this meeting. A motion could be made to <br />deny the permit, and he could appear before the City Council at their next meeting. This moves <br />the item off the Planning Commission docket and up to the City Council for a decision. He <br />asked what Mr. Enstrom wanted. <br /> <br />Mr. Enstrom stated he was confident the City Council would grant the extension. He requested <br />the permit be recommended for denial at this meeting so he could bring the issue to the City <br />Council. <br /> <br />Commissioner Johnson withdrew his earlier motion to continue to the next meeting. <br /> <br />Commissioner Brauer stated he does have a concern of people being laid off before winter. He <br />questioned that if for some reason Mr. Enstrom was allowed to keep operating until a decision <br />was made, what would the hours be. <br /> <br />Planning Commission/November 5, 2001 <br /> Page 8 of 20 <br /> <br /> <br />
