CASE # <br /> <br />REQUEST FOR A VARIANCE TO AMOUNT OF IMPERVIOUS SURFACE IN <br />THE CRITICAL RIVER OVERLAY DISTRICT AND THE WILD AND SCENIC <br />RIVER OVERLAY DISTRICT; CASE OF SUNFISH PROPERTIES, L.L.C. <br /> By: Principal Planner Patrick Trudgeon <br /> <br />Background: <br /> <br />Sunfish Properties, L.L.C. is proposing to redevelop the property located at the northwest <br />corner of the intersection of State Highway 10 and CSAH 57 (Sunfish Lake Blvd.). <br />McKay Auto Sales currently operates from the site. Sunfish Properties are proposing to <br />redevelop the property into two separate parcels. One parcel would contain a retail center <br />and the other a convenience gas station. The property is zoned B-3, Highway Business <br />District and the proposed uses are allowed in the B-3 Zoning District. <br /> <br />The southern part of this property (approximately 48,000 square feet) is within Critical <br />River Overlay District and the Wild and Scenic River Overlay District. Sections <br />9.21.07(1)(b) and 9.23.06(1) of the City Code does not allow for more than 30% of the <br />lot to be covered as impervious surface. The proposed site plans show approximately <br />144,587 sq. ft. covered with impervious surface or 60.9% impervious surface coverage <br />over the total 5.45 acres. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Location of Critical River/Wild and Scenic River Overlay District <br />Proposed findings of fact <br />Proposed variance <br /> <br />Notification: <br /> <br />As required by State law, property owners within 350 feet of the subject property were <br />notified of the public hearing. In addition, the DNR was notified of the variance as <br />required. <br /> <br />Observations: <br /> <br />As mentioned before, the two lots proposing to be developed are partially within both the <br />Critical River and Wild and Scenic River Overlay District. The property in question is <br />across Highway 10 (and in fact is the only piece of land within the river overlay districts <br />that is north of Hwy. 10.). The development parcel is approximately one quarter of a mile <br />from the Mississippi River. <br /> <br /> <br />
