Absent: Board Member Johnson. <br /> <br />BOARD BUSINESS/PUBLIC HEARINGS <br /> <br />Case #1: <br /> <br />Request for a Variance to Amount of Impervious Surface in the Critical <br />River Overlay District and the Wild and Scenic River Overlay District; Case <br />of Sunfish Properties L.L.C. <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:03 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearin~ <br /> <br />Chairperson Nixt called the public hearing to order at 7:03 p.m. <br /> <br />Presentation <br /> <br />Principal Planner Tmdgeon explained that Sunfish Properties, L.L.C. is proposing to redevelop <br />the property located at the northwest comer of the intersection of State Highway 10 and CSAH <br />57 (Sunfish Lake Boulevard). McKay Auto Sales currently operates from the site. Sunfish <br />Properties is proposing to redevelop the property into two separate parcels. One parcel would <br />contain a retail center and the other a convenience gas station. The property is zoned B-3, <br />Highway Business District and the proposed uses are allowed in the B-3 Zoning District. The <br />southern part of this property (approximately 48,000 square feet) is within the Critical River <br />Overlay District and the Wild and Scenic River Overlay District. Sections 9.21.07(1)(b) and <br />9.23.06(1) of the City Code does not allow for more than 30% of the lot to be covered as <br />impervious surface. The proposed site plans show approximately 144,587 square feet covered <br />with impervious surface or 60.9% impervious surface coverage over the total 5.45 acres. <br />Principal Planner Tmdgeon explained that the two lots proposing to be developed are partially <br />within both the Critical River and Wild and Scenic River Overlay District. The property in <br />question is across Highway 10 (and is the only piece of land within the River Overlay District <br />that is north of Highway 10). The development parcel is approximately one-quarter of a mile <br />from the Mississippi River. The operation in place already exceeds the maximum amount of <br />impervious surface allowed the Critical River and Wild and Scenic River Overlay District. The <br />current operation already exceeds the minimum impervious area with about 100,000 square feet <br />of the 5.45 acres being impervious surface (42% lot coverage). With the current operation, 100% <br />of the area within the River Overlay District is impervious surface. The new development shows <br />only about 69% of the area within the River Overlay District will be impervious surface. City <br />staff recommends approval of the variance contingent upon DNR certification of same. <br /> <br />Citizen Input <br /> <br />Chairperson Nixt noted the end result would be less impervious surface and more green space <br />than currently exists. <br /> <br />Board of Adjustment/April 3, 2001 <br /> Page 2 of 4 <br /> <br /> <br />
