Principal Planner Trudgeon stated that is correct. <br /> <br />Motion by Board Member Kociscak, seconded by Board Member Wivoda, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Kociscak, Wivoda, Reeve, and <br />Watson. Voting No: None. Absent: Board Member Johnson. <br /> <br />The public hearing closed at 7:06 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the regular meeting of the Board of Adjustment back to order at 7:06 <br />p.m. <br /> <br />Board Member Kociscak asked if the current owner has a permit on the impervious surface. <br /> <br />Community Development Director Frolik explained that the current car lot existed prior to that <br />regulation. <br /> <br />Chairperson Nixt asked if there are any restrictions on use within this Critical River area. <br /> <br />Principal Planner Trudgeon stated he is not aware of any use restrictions but will double check <br />the ordinance. <br /> <br />Chairperson Nixt noted it is only the triangular piece of property that would be impacted. <br /> <br />Principal Planner Trudgeon reviewed the area of the subject site that would be within that <br />Critical River area. He advised that the DNR was sent a copy of this application. <br /> <br />Motion by Board Member Kociscak, seconded by Board Member Watson, to adopt Resolution <br />#01-04-170 adopting Findings of Fact #0548 relating to Sunfish Properties request for a variance <br />to impervious lot coverage for the lot located at 6415 State Highway 10. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Kociscak, Watson, Reeve, and <br />Wivoda. Voting No: None. Absent: Board Member Johnson. <br /> <br />Motion by Board Member Kociscak, seconded by Board Member Watson, to adopt Resolution <br />#01-04-271 approving the issuance of a variance to Sunfish Properties request for a variance to <br />impervious lot coverage for the lot located at 6415 State Highway 10, contingent upon DNR <br />certification, and declaring terms of same. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Kociscak, Watson, Reeve, and <br />Wivoda. Voting No: None.
