Ms. Sweet replied that those cities do a risk assessment to determine if something happens and <br />they get sued, would they be able to afford it. <br /> <br />Commissioner Wivoda stated that he was present in 1998 when the Senior Complex was <br />approved and he remembered the promise that the aerial ladder truck would be placed on the <br />Capital budget. If the Board approves this variance with the stipulation that the Council consider <br />the purchase of an aerial ladder truck there is no guarantee anything will happen, but if they deny <br />the variance, then the applicant can go before the Council and it might become a higher priority. <br /> <br />Vice-Chairperson Kociscak stated that since the Board of Adjustment has already approved <br />similar variances, what would the rationale be for them not approving the variance. <br /> <br />Commissioner Sweet replied that two wrongs don't make a right. <br /> <br />Commissioner Watson stated that Ramsey is a growing city and he sees the same road block <br />facing the City in the future. <br /> <br />Vice-Chairperson Kociscak inquired if the Board were to deny the variance what would the <br />process be to go before the Council. <br /> <br />Community Development Director Frolik replied that the applicant could submit a written <br />request to appeal the decision at the Council level. <br /> <br />Vice-Chairperson Kociscak reviewed the findings of fact. <br /> <br />Motion by Commissioner Wivoda, seconded by Commissioner Sweet, to adopt Resolution #01- <br />05-__ adopting Findings of Fact # __ relating to a request by Amcor Precast to vary from <br />the height restriction for the proposed manufacturing addition amending findings of facts 10, 11, <br />and 12 to read "will not" and findings of fact #13 to read "will. <br /> <br />Motion failed. Voting Yes: Board Members Wivoda, and Sweet. Voting No: Vice-Chairperson <br />Kociscak, and Board Member Watson. <br /> <br />Motion by Vice-Chairperson Kociscak, to adopt Resolution #01-05- adopting Findings of <br />Fact # __ relating to a request by Amcor Precast to vary from the height restriction for the <br />proposed manufacturing addition, with findings 10,11 and 12, favorable to the applicant and <br />finding of fact # 13 reading "will not". <br /> <br />Motion failed for the lack of a second. <br /> <br />Motion by Vice-Chairperson Kociscak, seconded by Commissioner Wivoda, to adopt Resolution <br />#01-05- adopting Findings of Fact # relating to a request by Amcor Precast to vary <br />from the height restriction for the proposed manufacturing addition, with findings 10,11 and 12 <br /> <br />Board of Adjustment/May 1, 2001 <br /> Page 6 of 7 <br /> <br /> <br />
