Absent: Chairperson Nixt and Board Member Sweet. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case/ti: <br /> <br />Request for a Variance to the Side Yard Setback; Case of Thomas and <br />Carole Rachel <br /> <br />Vice Chair Kociscak closed the regular portion of the Board of Adjustment meeting at <br />7:16 p.m. in order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Vice Chair Kociscak called the public hearing to order at 7:16 p.m. <br /> <br />Presentation <br /> <br />Community Development Assistant Wald stated that Mr. Rachel came to the City and <br />applied for a building permit to construct a detached accessory structure on his property <br />located at 6350 163rd Lane N.W. During the inspection of the footings it became apparent <br />to the Building Inspector that the detached accessory structure was being constructed too <br />close to the side yard lot line. Per Staff's recommendation, Mr. Rachel has applied for a <br />variance to the side yard setback in order to continue construction of a detached accessory <br />structure on the property. City Code requires a 35-foot side yard setback on comer lots <br />for both principal and accessory structures. Mr. Rachel's building is proposing to be 15 <br />feet from the side property line. The subject property is bounded by 163rd Lane to the <br />north and Wolfram Street to the west. If the Applicant were to construct the 24' x 28' <br />(672 square feet) detached accessory structure in compliance with City Code, the <br />structure would be encroaching upon the existing drain field and the alternate drain field <br />location. The Applicant would also have to remove existing vegetation, which primarily <br />includes mature trees. The proposed detached accessory structure will not exceed the <br />accessory building square footage restrictions established in City Code. Due to the <br />location of the existing drain field, alternate drain fields, and existing mature trees, Staff <br />recommends approval of the variance. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Board Member Johnson, seconded by Vice Chair Kociscak, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Vice Chair Kociscak, Board Members Johnson, Reeve, and <br />Watson. Voting No: None.
