The public hearing closed at 7:17 p.m. <br /> <br />Board Business <br /> <br />Vice Chair Ko ciscak called the Board of Adjustment meeting back to order at 7:17 p.m. <br /> <br />Motion by Board Member Johnson, seconded Vice Chair Kociscak, to adopt Resolution <br />#01-08-257A adopting Findings of Fact #0564, favorable to the applicant, relating to <br />Thomas and Carole Rachel's request for a variance to encroach 20 feet into the side yard <br />setback on the property located at 6350 163rd Lane. <br /> <br />Motion carried. Voting Yes: Vice Chair Kociscak, Board Members Johnson, Reeve, and <br />Watson. Voting No: None. Absent: Chairperson Nixt and Board Member Sweet. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Reeve, to approve <br />Thomas and Carole Rachel's request for a variance on the property located at 6350 163rd <br />Lane, based on the findings of fact, and adopt Resolution #01-08-257B declaring terms of <br />the variance. <br /> <br />Motion carried. Voting Yes: Vice Chair Kociscak, Board Members Johnson, Reeve, and <br />Watson. Voting No: None. Absent: Chairperson Nixt and Board Member Sweet. <br /> <br />Case #2: <br /> <br />Request for a Variance to Front Yard Setback; Case of Robert and <br />Linda Staton <br /> <br />Vice Chair Kociscak closed the regular portion of the Board of Adjustment meeting at <br />7:17 p.m. in order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Vice Chair Kociscak called the public hearing to order at 7:18 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik explained that Section 9.11.02 of the Ramsey <br />City Code states that no accessory structure shall be constructed nearer the front property <br />line than the principal structure. Mr. Staton is proposing to move a garage onto his <br />property and has applied for a variance to place it nearer the fi'ont property line than the <br />principal structure on the property at 14490 Bowers Drive NW. The property is located <br />on Bowers Drive, along the Mississippi River. Bowers Drive is considered the front yard <br />and the Mississippi River is considered the back yard. In 1985, the City adopted <br />regulations for properties within the Critical River Corridor. One of the regulations is <br />that there shall be a 200-foot structure setback from the ordinary high mark.
