lawful nonconforming. Placement of the new garage in the back yard between the house <br />and river would not comply with the setback from the Mississippi River. The better <br />alternative is to construct the garage in the front yard. The home on the property is <br />located approximately 276 feet from the front property line. Mr. Davis is proposing to <br />construct the new garage approximately 48 feet from the front property line to avoid the <br />septic system tanks and minimize destruction of mature trees. Similar variances have <br />been granted in the past, many of which were for properties along Bowers Drive. City <br />Staff recommends approval of the variance application. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Reeve, to close the <br />public hearing. <br /> <br />Motion carried. Voting Yes: Vice Chair Kociscak, Board Members Johnson, Reeve, and <br />Watson. Voting No: None. Absent: Chairperson Nixt and Board Member Sweet. <br /> <br />The public hearing closed at 7:19 p.m. <br /> <br />Board Business <br /> <br />Vice Chair Kociscak called the Board of Adjustment meeting back to order at 7:19 p.m. <br /> <br />Commissioner Johnson stated he is familiar with the area and the applicant's request is <br />consistent with other structures in the area. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Watson, to adopt <br />Resolution #01-08-258A, adopting Findings of Fact #0565 relating to Robert Staton's <br />request for a variance to construct an accessory structure nearer the front property line <br />than the principal structure at 14620 Bowers Drive N.W. <br /> <br />Motion carried. Voting Yes: Vice Chair Kociscak, Board Members Johnson, Watson, <br />and Reeve. Voting No: None. Absent: Chairperson Nixt and Board Member Sweet. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Watson, to approve Mr. <br />Staton's request for a variance at 14620 Bowers Drive N.W., based on the findings of <br />fact, and adopt Resolution #01-08~258B declaring terms of the variance. <br /> <br />Motion carried. Voting Yes: Vice Chair Kociscak, Board Members Johnson, Watson, <br />and Reeve. Voting No: None.
