Voting No: None. <br /> <br />BOARD BUSINESS/PUBLIC HEARINGS <br /> <br />Case #1': <br /> <br />Request for a Variance to Rear Yard Setbacks; Case of Dan and Theresa <br />Carter <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:06 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:06 p.m. <br /> <br />Presentation <br /> <br />Principal Planner Trudgeon stated that Mr. and Mrs. Carter have applied for a variance to <br />encroach into the rear yard setback in order to construct an addition onto their principal structure <br />on the property located at 14531 Sunfish Lake Dr. NW. The Carters would like to construct a <br />four-season porch addition to their residence. Since the addition will be habitable space, they are <br />required to adhere to the setbacks for the R-1 Zoning District. The required rear yard setback is <br />35 feet. With the construction of the addition, the Carters will be 20.5 feet from the rear property <br />line; a rear yard encroachment of 14.5 feet. The Carter's house is a comer lot and is surrounded <br />by three streets. Principal Planner Tmdgeon also explained the Carters cannot construct the <br />addition on their western side of their lot (145th Avenue) since the principal structure is already at <br />the required setback line and the proposed addition would not fit on the property. They also <br />cannot construct on the eastern side of the lot, since the addition would encroach in the required <br />10' side yard setback. Therefore, the Carters are asking for a variance to the rear yard setback as <br />they believe it will have the least impact to the surrounding property owners. As the rear lot line <br />of the Carter's lot abuts the right-of-way for Sunwood Drive, granting the variance to the rear <br />yard setback will not impact any neighbors to the south.
