Absent: Board Members Kociscak and Reeve.

BOARD BUSINESS/PUBLIC HEARINGS

Case #1:

Request for a Variance to Septic System Setback Requirements; Case of Jim
and Joanne Kusler

Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:01 p.m. in
order to conduct the public hearing.

Public Hearing

Chairperson Nixt called the public hearing to order at 7:01 p.m.

Presentation

Principal Planner Trudgeon explained that Jim and Joanne Kusler have applied for a variance
from the minimum separation between a septic tank and building in order to replace their failed
septic system on the property located at 16941 Yttrium St. NW. The Kuslers have limited area
where they can put the new drainfield since their well is located in the front yard and the
drainfield is required to be located 50 feet from any wells. State law requires the drainfield to be
setback 10 feet from the lot line and 20 feet from a residence. The Kuslers are requesting a
variance to locate the drainfield five feet from the north property line and ten feet from the
residence. Ramsey Building Official Glyn Huff has reviewed the request and indicates support
of the variance since them is no choice for another location if the applicant is to maintain the 50~
foot separation from the well. Building Official Huff also states that the flow of the drainage will
be directed away from the basement due to the slope of the lot and therefore the location of the
drainfield ten feet from the house should not cause any problems. Staff learned on October 29,
2001 that the septic system was installed by Scott Salonen during the week of October 22. Mr.
Salonen indicated that he knew that the septic system needed a variance prior to installation, but
installed it anyway.

Citizen Input

None.

Board of Adjustment/November 5, 2001
