Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:07 p.m. <br /> <br />Presentation <br /> <br />Principal Planner Trudgeon stated the Houdes have applied for a variance to encroach into the <br />rear yard setback in order to construct an addition onto the principal structure on the property <br />located at 6831 146~h Circle, NW. Mr. and Mrs. Houde would like to construct a 16' x 21' <br />addition onto their home due to their growing family. The addition is proposing to encroach <br />twenty feet into the 35-foot rear yard setback established in the R-1U Residential district. The <br />Houde's house was constructed in 1998 and encroaches approximately 8.5 feet into the rear yard <br />setback. Staff finds no record of a variance granted for this lot and is unable to determine why <br />the house was constructed in the rear yard setback area. Nevertheless, a variance will be needed <br />to allow for the existing setback encroachment. The lot is pie shaped and is located at the end of <br />the 146th Circle cul-de-sac. The property has residences to the north and south and abuts the <br />landfill property to the east. The existing residence is situated in such a way to make any <br />proposed addition to the house encroach into the existing rear yard setback. As it relates to the <br />existing structure encroachment, they have no option besides tearing down the structure if they <br />are required to conform to the required setbacks. There is a trail behind the home. If the <br />variance is granted, the residence will be located no closer than 32 feet from the side (south) <br />property line and 15 feet from the rear lot line. Based on the above observations, staff <br />recommends approval of the variance. <br /> <br />Citizen Input <br /> <br />None. <br /> <br />Motion by Board Member Johnson, seconded by Chairperson Nixt, to close the public hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Sweet, and <br />Watson. Voting No: None. Absent: Board Members Kociscak and Reeve. <br /> <br />The public hearing closed at 7:09 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:09 p.m. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Watson to adopt Resolution <br />#01-11-403 adopting Findings of Fact favorable to the applicant relating to Chad and Michelle <br />Houde's request for a variance to encroach 20 feet into the rear yard setback on the property <br />located at 6831 146th Circle NW. <br /> <br />Board of Adjustment/November 5, 2001 <br /> Page 4 of 7 <br /> <br /> <br />
