DRAFT <br /> <br />MnDOT Contract No 87007 <br /> <br /> STATE OF MINNESOTA <br /> GRANT CONTRACT <br />Federal Project Number'MN-03-0069-01 <br /> <br />T[[IiS (JRANT (;ONTRACT, which shall be interpreted pursuant to the laws of the state of Minnesota, is between the <br />state o r Minnesota, acting through its Commissioner of Transportation ("STATE") and the Ciiy <br /> <br /> Background <br /> <br />STATF. applied to the Federal Transit Administration for a Section 5309 Capital Program Grant for the construction of a <br />park-and-ride ['acilit3, in the City of Ramsey. STATE is authorized by Minnesota Statutes, Section 174.23, Subdivision l <br />~o disburse federal lhnds fbr public transit purposes as provided in Minnesota Statutes, Section 174.21. GRANTEE is <br />authorized by Minnesota Statutes, Section 398A.04, Subdivision 7 to receive federal and state grant funds. The purpose of <br />~.his Grant Contract is to reimburse GRANTEE for the acquisition of property for a park-and-ride facility. <br /> <br />?,i OYV~ THE R E FORE, it is agreed: <br /> <br />TkiRM OF CONTRACT. <br />This (;rant Contract is effective upon execution by appropriate STATE and GRANTEE officials during the period <br />l'rom .luly 1,2004 through December 31, 2005. <br /> <br />GRANq'I';I";'S DUTIES. GRANTEE will: <br /> <br />A. Acquire real property for a park-and-ride facility in the City of Ramsey for approximately 150 <br /> vehicles, according to the project description and budget which is attached and incorporated into this <br /> Grant Contract as Exhibit I; <br />B. provide a 20% match, in cash or in kind, to the federal funds provided in Article III; <br />C. comply with federal real property requirements in FTA Circular 50t0.1C GRANT <br /> MANAGEMENT GUIDELINES, especially Chapter II Real Property, Equipment and <br /> Supplies; <br />D. provide STATE with an equivalent replacement park-and-ride facility that is agreeable to STATE, if <br /> the fhcility at the site described in Exhibit I undergoes construct/on or is otherwise unavailable; and <br />E. ensure that public transit service will be provided to this park-and-ride facility no later than December <br /> 31, 2008. If public transit service does not exist to this park-and-ride facility by December 31, 2008, <br /> GtLANTEE will repay STATE any funds previously paid to GRANTEE under this Grant Contract. <br /> <br />[il, <br /> <br />CONSII)ERATION AND TERMS OF PAYMENT <br />STATE shall pass through to GRANTEE a total obligation not to exceed $420,000.00 for acquisition of real <br />property £or a park and ride facility in the City of Ramsey, according to the project description and budget in <br />Exhibit !. GRANTEE shall present STATE with a completed Request for Funds form, which is attached and <br />incorporated into this Grant Contract as Exhibit II. An appraisal for the value of the real property of occupied by <br />the park-and-ride facility must accompany the Request for Funds form. STATE will conduct a formal review of <br />thc appraisal submitted by GRANTEE. Mn/DOT will then submit the original appraisal and the review appraisal <br />to thc Federal Transit Administration (FTA) for approval. Reimbursement shall be made by STATE, not.to <br />cxcccd each invoiced amount, within 30 days after STATE has received FTA approval. <br /> <br />IV. <br /> <br />CONDITIONS OF PAYMENT. All services provided by GRANTEE pursuant to this grant shall be performed to <br />the satisfaction of STATE, as determined in the sole discretion of STATE's Authorized Agent, and in accord with <br />all applicable federal and state laws. GRANTEE shall not receive payment for work found by STATE to be <br />tmsatist'actory, or performed in violation of federal o;c state law. <br /> <br />AIJq'I-IORIZED AGENTS.
