Home <br /> <br />All Park and Open Space Dedication requirements listed under Section <br />9.50.30 - Subd. 10 shall apply to cluster subdivisions. Th.e highest <br />priority will be given to portion(s) of the development site identified for <br />protection in the City's Comprehensive Plan and the Master Park and Trail <br />Plan. The City Council and the developer may also negotiate scenic and ' <br />conservation easeme, nts for high-value open space located within proposed <br />cluster gubdivisions. <br /> <br /> Owners Associations (HOAs) <br /> <br /> The develgper shall be required to gstablish a Home Owners <br /> Association (HOA), whose bylaws and articles of incorporation <br /> ,must be reviewed by the City during the plat approval process. <br /> ? <br />2. · Such bylaws must recognize that the' remnant parcel may be <br /> developed in the future. <br /> <br />Design Of Sew. er and Water Facilities, <br /> <br />Wate~- faci'lities may be provided by }ndividual or; community <br />wells. Corm'nunity wells are the preferred i'nethod of water <br />provision. All wells are required to meet Minnesota Department of <br />Health. standards <br /> <br />Sewage treatment facilities may be ,located in commonly held or <br />· identified open space~ areas and protected with easements as <br />determined to be necessary. The system must be located on a <br />parcel controlled by the Home Owners Associati0n'. Tlzis parcel <br />must be .separate from the remainder of the parcel. <br /> <br />The developer shall submit design information on communal " <br />systems (prepared by a Certified designer) that verifies the site's r <br />ability'tO support a system that accommodates the proposed <br />development, '. <br /> <br />The City (and other monitoring 'agencies) must bb provided with an <br />annual inspectiori rep6rt of the communal system, prepared by a <br />certified inspector. <br /> <br />The HOA shall maintain a sufficient escrow for repair and/or <br />replacement or_the communa! septic sys,tem. <br /> <br />6~ <br /> <br />Upon hookup to CJ~ty sewer and water, the communal System must <br />be properly abandoned according ~o Mimxesota Pollution Control <br />Agency standards; compliance wilt be verified prior to conn_ection · <br />to City services. <br /> <br /> <br />
