Councilmember Hendriksen inquired as to what the disadvantages were for not constructing the <br />road in front of Danny's Tranny at this time. <br /> <br />City Administrator Norman explained that sewer and water is coming from the north and without <br />the roadway being extended in front of Danny's Tranny people would be driving on a private <br />street owned by Commercial Asphalt. <br /> <br />Councilmember Hendriksen inquired if a document was drafted by the City, which stated that the <br />City intends on acquiring the right-of-way in the future, would that satisfy the concerns of <br />Commercial Asphalt. <br /> <br />City Engineer Olson replied that he felt it would. <br /> <br />Councilmember Kurak stated that it seemed as if the property in discussion will be redeveloped <br />in the future and questioned why the City would pay to move a business that might be going <br />away in the next five years. <br /> <br />City Administrator Norman replied that staff would like to continue negotiations with Danny's <br />Tranny. <br /> <br />Councilmember Hendriksen stated that he felt that the Council should first determine whether or <br />not the use should continue on the property. He explained that the business has had a long <br />history of failing to meet the commitments of the conditional use permit. <br /> <br />City Administrator Norman replied that the property owner will argue that they are new owners <br />of the business and will comply with the terms of the conditional use permit. <br /> <br />Consensus of the Committee was to direct staff to do further research on the history of the <br />conditional use permit and at this point end the project west of Danny's Tranny. <br /> <br />Case #2: Update for County Ditch #43 <br /> <br />City Engineer Olson stated that Improvement Project 00-26 consists of three phases. The first <br />phase of the project is to maintain the ditch by excavating the deposited sediment from the ditch <br />channel so as to eliminate the flooding of 153ra Avenue NW during periods when the storm <br />sewer system has frozen. This phase of the project will not adversely affect the adjacent property <br />owners, as it will serve to improve drainage. The second phase of the project is the construction <br />of a ditch block. The Department of Natural Resources, as mitigation for the filling of Wetland <br />114P, introduced the requirement of this phase of the construction. The third phase of this <br />project is the cleaning of the ditch between the ditch block and the existing unnamed wet pond to <br />the south of the residential neighborhood. This phase of the project would serve two purposes: <br />ensuring positive drainage once the water reaches the ditch block elevation and improve drainage <br />in the residential area. To date the City has yet to receive signed flowage easements for the <br />parcels necessary for the second phase of this construction.
