5: City Attorney Report Back on Wayne Johnson Request <br /> <br />City Engineer Olson stated that the City Attorney wrote a letter in response to Mr. Johnson's <br />request indicating that the storm water trunk charge is a charge and had been collected <br />consistently on commercial and industrial development in the City of Ramsey. The Council will <br />be provided a copy of the letter at the next City Council meeting. <br /> <br />Wayne Johnson reviewed a letter from his Attorney that was sent to the City. <br /> <br />Councilmember Zimmerman stated that the Council presently does not have the letter that was <br />sent to Mr. Johnson from the City Attorney and for that reason could not respond to it. <br /> <br />6: 153ra/155th Project <br /> <br />City Engineer Jankowski stated that the City has acquired all of the necessary land that is needed <br />for the project with the exception of one parcel. He contacted the property owner to see if they <br />would reconsider and during the conversation staff inquired if the Committee would agree <br />$1,000 be a counter offer. The property owner did not give an indication whether or not he <br />would accept the $1,000 if the Committee authorized, but staff did offer to present the option to <br />the Committee. <br /> <br />Councilmember Hendriksen inquired if it would be possible to complete the project without the <br />easement, with the only problem being that there would not be the amount of easement behind <br />the project as staff would like. <br /> <br />City Engineer Jankowski replied that that was correct. <br /> <br />City Engineer Olson noted that without the easement the property owner could place a fence up <br />on his property and it would only be a few feet from the road. <br /> <br />City Engineer Jankowski stated that the amount of land they are talking about is 480 square feet <br />and the last direction of the Committee was to offer $500, which was refused. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to offer the property owner $750 <br />for the 480 square feet. <br /> <br />Further discussion: Councilmember Hendriksen suggested including in the motion that the City <br />will not exceed $750 at any point in the future, because than everyone will think that they can get <br />10 times the assessed value by declining offers. Mayor Gamec replied that he is concerned that <br />they may have to go back in the future if the City were to construct a trail along 153rd/155th. <br /> <br />Motion by Councilmember Hendriksen, indicating that the $750 would be the final offer made by <br />the City. <br /> <br />Public Works Committee/March 20, 2001 <br /> Page 8 of 9 <br /> <br /> <br />
