City Engineer Jankowski stated that there were several suggestions offered by the people during a <br />public hearing to improve the access problems to Rivers Bend Plaza. One of the more concrete <br />offers was for Rivers Bend to hire a consultant, but staff has not had a response fi.om them as of <br />yet. Staff will contact them regarding the issue. <br /> <br />3. Update on 141st Avenue NW in Gateway Industry Park No. 5 <br /> <br />City Engineer Olson stated that Commercial Asphalt requested a commitment from the City as to <br />when the access issue in front of Danny's Tranny will be resolved. Staff discussed the issue with <br />the City Attorney and he advised staff that the City should not get into any agreement that <br />specifies a time line because of the ramifications it could have. <br /> <br />Councilmember Zimmerman stated that cost of including the extension through Danny's Tranny <br />site does not seem reasonable. <br /> <br />Councilmember Kurak agreed. <br /> <br />Councilmember Anderson stated that she still has concerns as to environmentally what is on the <br />Danny's Tranny site. <br /> <br />Councilmember Hendriksen replied that he has the same concern. He stated that horrendous <br />things have gone taken place on the site and feels that the Council should be considering whether <br />they should terminate the conditional use permit. <br /> <br />City Engineer Olson stated that it appears that St. Paul's Terminal will have to reassign the <br />conditional use permit from Danny's Tranny to their business name. <br /> <br />Councilmember Anderson stated that the conditional use permit was issued to Danny's Tranny <br />and runs with the land so it would automatically transfer to St. Paul Terminal. <br /> <br />City Engineer Olson replied that the conditional use permit states that the permit is specific to the <br />owner of the property, but would clarify that. <br /> <br />Councilmember Kurak requested a copy of Danny's Tranny conditional use permit. <br /> <br />City Administrator Norman stated that he would get a copy of the permit for the entire council. <br /> <br />Councilmember Hendriksen requested that the history of Danny's Tranny also be reviewed. <br /> <br />Councilmember Zimmerman requested that the issue be placed as a work session item. <br /> <br />4.
